Terms of Service

Ovexly and the website ovexly.com (the “Service”) are operated by Ovexly Trading LLC, a limited liability company registered in the State of Wyoming, United States. “Ovexly”, “we”, “us” and “our” mean Ovexly Trading LLC. “You” means the person using the Service.

Ovexly Trading LLC is a registered company. Company registration is a business registration, not a licence or authorisation from a financial regulator, and Ovexly does not claim to be licensed or regulated in any jurisdiction.

By creating an account, signing in, or using the Service, you agree to these Terms, our Privacy Policy, our Risk Disclosure and our AML & KYC Policy. If you do not agree, do not use the Service. Specific features such as funded evaluations, tournaments, promotions and the referral programme may have additional rules shown where you join them; those rules form part of these Terms.

To use the Service you must:

• be at least 18 years old, or the age of legal majority where you live if that is higher;
• have the legal capacity to enter into a binding agreement;
• use the Service only where doing so is lawful for you; and
• not be a person subject to sanctions administered by the US Office of Foreign Assets Control (OFAC) or comparable authorities.

You are responsible for checking that using the Service is legal in your country. We may restrict or refuse the Service in any country or to any person at our discretion, including where local law requires it.

• Give accurate, complete information and keep it up to date.
• You may hold one personal account. Duplicate or shared accounts may be closed.
• Keep your password, email account and any Google account you sign in with secure. You are responsible for activity on your account until you tell us it has been compromised.
• Do not open an account for, or let your account be used by, anyone else.
• We will never ask for your password or one-time codes, and we never send deposit addresses by email or chat.

We may ask you at any time, including before a withdrawal, to verify your identity, address, or the source of your funds, as described in our AML & KYC Policy. Until verification is complete we may limit deposits, trading or withdrawals. If you cannot or will not provide the information requested, we may close your account.

• The payment methods available to you, and any fees or limits, are shown in your account before you confirm.
• For crypto deposits, send only the asset and network shown on your deposit screen, to the address shown there. Crypto transfers cannot be reversed; funds sent to the wrong address or network may be lost.
• Withdrawals are paid to a payment method or wallet address that you own and control.
• Withdrawals may be reviewed before they are processed. Processing times depend on the method and on any verification we need.
• If funds are credited to your account by mistake, including through a technical error, we may reverse that credit.
• Deposits are for trading on the Service. Using the Service only to move money is not allowed.

Ovexly offers short-expiry UP/DOWN contracts on forex, crypto, gold and selected stock CFDs. For every trade:

• Your entry price is the price on the Service at the moment your trade is executed.
• The payout percentage shown when you open the trade is fixed for that trade.
• At expiry, the exit price is compared with the entry price, both at the instrument's displayed precision. An UP trade wins if the exit price is higher and loses if it is lower; a DOWN trade is the reverse. If the prices are equal, the trade is a draw and your stake is returned.
• A winning trade returns your stake plus the payout; a losing trade loses the stake.
• Where early close is offered, the amount you receive is shown before you confirm.

Prices come from Ovexly's own market data and may differ slightly from other sources. If a trade is executed or settled on a clearly erroneous price, or a technical failure prevents normal settlement, we may cancel that trade and return the stake. Funded evaluations are trading assessments on simulated capital; they are not live trading accounts and the balances shown are not your money. The evaluation phases, targets, drawdown limits, fees and profit-share payouts are those shown on the funded accounts page and in your dashboard when you buy the evaluation. Breaking a rule ends the evaluation. Profit-share payouts are subject to the programme rules and to verification.

Tournaments use competition capital that is separate from your real balance. Each tournament's schedule, scoring, prizes and rules are shown on its page. Rankings are calculated by our servers. We may disqualify participants who break the tournament rules or these Terms, and withhold any prize connected to that breach.

Bonuses and promotions are optional and carry the conditions shown when you accept them, which may limit when bonus funds can be withdrawn. Referral and affiliate rewards are paid under the programme rules shown in your account. Self-referrals, fake or duplicate accounts, and spam are not allowed. We may remove bonuses, promotions or referral rewards obtained in breach of these Terms.

You must not:

• open or control multiple accounts, or trade in coordination with others to manipulate results;
• exploit price errors, delays, latency, or software bugs, or use automated tools to do so;
• use the Service for fraud, money laundering, terrorist financing, or any other unlawful purpose;
• use funds or payment methods that are not yours, or start unjustified chargebacks;
• attempt to access accounts or systems without permission, reverse engineer the Service, or disrupt it;
• impersonate Ovexly or our staff, or misuse our name and logo.

If we reasonably believe you have broken these Terms or the law, or to protect you, other users or the Service, we may suspend or close your account, cancel affected trades, bonuses or rewards, hold funds connected to the issue while we investigate, and report matters to the relevant authorities.

You may close your account at any time from support. Your available balance will be paid out to you, subject to any verification required and to amounts owed under these Terms.

Trading involves risk of loss, and you may lose the whole stake on any trade. Past results do not predict future results, and Ovexly does not promise profits. Content on the Service, including the blog, is general education and not investment, financial, tax or legal advice. Please read the Risk Disclosure and use the responsible trading tools.

The Service, including the Ovexly name, logo, software, charts and content, belongs to Ovexly Trading LLC or its licensors. You may use the Service for your own personal trading only. You may not copy, resell or redistribute it without our written permission.

We work to keep the Service available and accurate, but it is provided “as is” and “as available”. It may be interrupted for maintenance, updates, or reasons outside our control, such as internet, hosting or market data outages. We may change, add or remove features at any time.

To the fullest extent permitted by law, Ovexly Trading LLC is not liable for trading losses resulting from your decisions, or for any indirect, incidental, special or consequential loss, including loss of profit, revenue, data or opportunity.

To the fullest extent permitted by law, our total liability to you for any claim relating to the Service is limited to the fees you paid to Ovexly in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

You agree to compensate Ovexly Trading LLC for losses, costs and claims, including reasonable legal fees, that arise from your breach of these Terms or your misuse of the Service.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you have a complaint, please contact support first so we can try to resolve it. Any dispute that cannot be resolved informally will be subject to the courts located in the State of Wyoming, unless the law of your country gives you a right to bring it elsewhere.

We may update these Terms from time to time. The date at the top shows the latest version. For material changes we will give notice on the Service or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
